The Cassation, by order no. 18222 of 5 July 2019, established that in relation to the custody of minor children, the requirement for the parents to undergo an individual psychotherapy course and another, to be followed together, to support parenting implies, even if considered not mandatory, conditioning likely to affect the freedom of self-determination to care for one’s health, meaning it is in contrast with Articles 13 and 32, paragraph 2 of the Constitution.
