Liability for poor road maintenance causing damages to pedestrians

In the case of culpable injuries sustained by a pedestrian as a result of the poor maintenance of the road, the liability is held by the person who, within the municipal administration, was delegated by the Mayor or by the municipal regulation to maintain the same (Criminal Cassation, Section IV, ruling 17 April 2019, no. 16597).
